Serenity Circle Participation Waiver of Liability and Assumption of Risk Agreement
Welcome to Serenity Circle — a supportive online space to help you find calm in the chaos of a loved one’s addiction.
Please read this Waiver of Liability and Assumption of Risk Agreement ("Agreement") carefully before joining Serenity Circle ("the Community"). By becoming a member of the Community, you acknowledge and agree to the following terms:
1. Assumption of Risk:
I understand that participating in classes, workshops, support groups, and other activities offered by Serenity Circle may involve physical, emotional, and mental exertion. I voluntarily assume all risks associated with my participation, including but not limited to injury, illness, emotional distress, or any harm that may occur as a result of my participation.
2. Physical and Emotional Health:
I confirm that I am in suitable physical, emotional, and mental condition to participate in the activities offered by the Community. I understand that it is my responsibility to consult with a medical or mental health professional if I have any concerns about my ability to participate safely.
3. Not Professional Medical or Mental Health Services:
I understand and acknowledge that Serenity Circle is a peer support community and does not provide professional medical care, mental health treatment, addiction treatment, or therapy. The information, discussions, and activities offered through the Community are for educational and supportive purposes only and are not intended to replace professional medical advice, diagnosis, or treatment. I understand that I should not rely on information from the Community as a substitute for professional medical or mental health care, and I will continue to work with qualified healthcare professionals for any medical or mental health needs.
4. Confidentiality and Privacy:
I understand that while Serenity Circle encourages a supportive environment, the Community cannot guarantee complete confidentiality of information shared in online group settings. I agree to respect the privacy of other members and not share personal information disclosed by others outside the Community. I understand that in certain circumstances, confidentiality may be limited by law, including situations involving imminent danger to self or others.
5. No Guarantees of Outcomes:
I understand that Serenity Circle makes no guarantees, promises, or warranties regarding specific outcomes, results, or benefits from participation in the Community. I acknowledge that individual results may vary and that my participation does not guarantee any particular outcome regarding my personal situation or my loved one's recovery.
6. Voluntary Participation:
I understand that my participation in Serenity Circle is entirely voluntary, and I may withdraw from the Community at any time. I acknowledge that I am responsible for my own choices and actions during my participation.
7. Technology and Communication Risks:
I understand that participation in online activities, including video calls, forums, and digital communications, involves inherent risks related to technology, internet connectivity, and digital security. I assume all risks associated with technology use and agree that Serenity Circle is not responsible for technical difficulties, security breaches, or communication failures.
8. Release of Liability:
I hereby release and discharge Serenity Circle, its founder, instructors, facilitators, staff, contractors, and any associated entities from any and all liability, claims, demands, actions, or causes of action, whether at law or in equity, arising out of my participation in the Community's activities.
9. Indemnification:
I agree to indemnify and hold harmless Serenity Circle, its instructors, facilitators, staff, and any associated entities from any liability, claims, demands, actions, or causes of action, including legal fees, that may arise as a result of my participation in the Community.
10. Agreement to Follow Community Guidelines:
I agree to abide by all community guidelines, terms of use, and any other rules and regulations established by Serenity Circle for its members. I understand that violation of these guidelines may result in removal from the Community.
11. Age Requirement:
I confirm that I am at least 18 years of age and have the legal capacity to enter into this Agreement.
12. Modification of Agreement:
I understand that Serenity Circle reserves the right to modify this Agreement at any time. I agree to review any updated versions and understand that continued participation constitutes acceptance of any modifications.
13. Severability:
If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
14. Governing Law and Jurisdiction:
This Agreement shall be governed by and construed in accordance with the laws of the State of Connecticut, USA. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Connecticut.
